CIIPC Research Fellow presents a paper at First IP & Innovation Researchers of Asia Conference

Khushbu Kumari, Research Fellow, CIIPC, presented the paper titled “Competition Law in Agri-Biotech in India”, co-authored with Mr. Yogesh Pai, at the First IP & Innovation Researchers of Asia Conference on 31 January – 1 February 2019 held at International Islamic University, Malaysia. The paper analyses the prima facie order of the Competition Commission of India in the matter of Nuziveedu Seeds Ltd v. Mahyco Monsanto Biotech (India) Limited on licensing of BG cotton technology by Monsanto to the seed companies in India. She dealt with three main issues. Firstly, the principles for delineation of relevant market in the case of licensing of technology. Secondly, the necessary conditions for application of Section 3 of the Competition Act, 2002 defining anticompetitive agreement. Thirdly, issues regarding the application of competition law in the licensing of IPR were analysed with a comparative study of the impugned order with the previous orders of the CCI on the matter.
